Prita Mulyasari Cleared of Charges
VIVAnews - The Tangerang District Court has cleared Prita Mulyasari of criminal defamation case brought against her by two doctors from Omni International Hospital Alam Sutera, Tangerang, Banten.
Judge Arthur Harnewa passed the verdict and said that Prita’s good name would now be restored. All charges against her have now been dropped.
The board of judges mentioned that Prita called on the hospital to issue the medical record. However, Omni Hospital did not hand in the complete report.
"It was true that on August the twelfth, 2009, the defendant came to Bintaro Hospital to have medical check-up under the condition of swollen arms, bulging eyes, and fever," he said.
According to the judge, doctor Grace, customer service officer who received Prita's complaint had been unprofessional by leaving the reply to other person.
Prita's email, according to the judge, did not violate any law. "The statements (in the letter) are criticisms and are used for the interest of the public," he said.
Earlier, prosecutors charged her of six months of imprisonment on Wednesday, Nov 18.
According to the prosecutors, the email sending to 20 recipients in Prita contacts infringed Article 27 section (3) jo Article 45 section 1 of Law No.11/2008 on Information and Electronic Transactions and defamation.
Based on the newly-applied law, Prita was facing an imprisonment of maximally six years and a fine of Rp 1 billion.
