President Jokowi Approves Changes to State Ministry Law

Jakarta, VIVA – Indonesian President Joko Widodo (Jokowi) has officially signed Law No. 61 of 2024, which amends Law No. 39 of 2008 on State Ministries.

The new law, jointly approved by the House of Representatives (DPR) and the President, introduces several key changes to the previous legislation.

One of the main changes includes the addition of Article 6A between Articles 6 and 7. This new article states:

"In certain cases, the formation of a separate ministry may be based on specific government functions or the details of government tasks, as long as they are related to the scope of government affairs,”

Another addition is Article 9A, inserted between Articles 9 and 10, which reads:

"If there is a law that specifies or regulates an organizational element as referred to in Article 9, the President may modify that organizational element through implementing regulations as needed for government administration,”

The provisions of Article 15 were also revised to state: "The total number of ministries formed is determined by the President based on the needs of government administration."

Article 25 outlines four points:

1. The functional relationship between ministries, non-ministerial government agencies, non-structural bodies, and/or other government institutions must be carried out synergistically as part of a unified government system according to the law.

2. Non-ministerial agencies are under the President’s authority and report to the President through the coordinating minister, unless otherwise determined by the President.

3. Non-structural bodies and/or other government institutions operate and report in accordance with the President’s directives or legal provisions.

4. Further regulations on non-ministerial government bodies, non-structural bodies, and/or other government institutions will be specified by a Presidential Regulation.
